Forgottengoldappeal.com is a business name of Glasson Recycling Ltd, a company incorporated in the Republic of Ireland hereafter referred to as “Glasson Recycling”. By requesting a forgottengoldappeal.com Gold Appeal Recycle Pack, either by telephone or via our online order form, you the Donor hereby agree and accept in their entirety the terms and conditions set forth below. Glasson Recycling purchases second hand gold jewellery for recycling. All gold jewellery (also referred to as second hand, old, broken, unwanted or forgotten gold) purchased is treated as scrap gold, is melted down and refined and is not for resale. Prices are based solely on the weight and the carat grade of the gold contained in the gold jewellery, not on its potential value if resold intact. Any gemstones in the gold jewellery should be removed before the gold jewellery is submitted to Glasson Recycling.
Requirements For Use:
Each Donor must be at least eighteen (18) years of age in order to donate gold jewellery to their chosen charity via Glasson Recycling. Each Donor must be the lawful owner of all gold jewellery submitted and may not be acting as an agent or representative of the actual owner. Glasson Recycling may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph.
Gold Appeal Recycle Card:
You, the Donor, agree to complete and sign the Gold Appeal Recycle Card. You will receive a Gold Appeal Recycle Card from us by post as part of the Gold Appeal Recycle Pack. If we determine, in our sole discretion, that insufficient information has been provided, or if no Gold Appeal Recycle Card was included in the package, we may suspend or terminate the transaction with notice to you. In the event that we terminate the transaction, we will post your gold jewellery to you within two (2) business days at our cost and you agree that we will only be responsible for insuring the value of your gold jewellery up to a maximum of Two Hundred Euro (€200). In the event that a return address is not provided by you, we will hold the jewellery for a period of two (2) months, during which time the jewellery may be claimed. Any claims must be reasonably supported by evidence of ownership. Any jewellery remaining unclaimed after two months will be recycled and the proceeds donated to a charity nominated by Glasson Recycling Limited.
Guarantee Against Loss:
We provide each Donor with specific instructions regarding how each Donor must send their gold jewellery to us using the postal service and a free post envelope provided by Glasson Recycling as part of the Gold Appeal Recycle Pack. In the event that the Donor strictly follows these instructions and uses the free post envelope, Glasson Recycling guarantees against loss to the maximum value of Two Hundred Euro (€200) of the total contents properly sent by post to Glasson Recycling in accordance with the instructions outlined in the Gold Appeal Recycle Card provided as part of the forgottengoldappeal.com Gold Appeal Recycle Pack and subject to the terms and conditions herein. The Donor is obliged to provide proof of postage documentation (provided free of charge at the Post Office) in order to make any claim against this guarantee. Glasson Recycling reserves the right, in its sole discretion, to reject delivery of any post or package which appears to be damaged, opened, or tampered with and any such post, envelope or package will be returned by the Post Office to the Donor. Glasson Recycling shall have no liability to any Donor for any such attempted delivery or return of any such post or package.
Claim Period and Related Restrictions:
All claims must be submitted within thirty (30) days of the date of loss and must be submitted on the supplied forgottengoldappeal.com Claim Form, which is available upon request. Each Claim Form must be accurately completed and provided to Glasson Recycling within the thirty day (30) claim period, complete with all required documentation as set forth herein including proof of postage documentation and as requested by Glasson Recycling or the claim will be summarily rejected by Glasson Recycling. No claim may be submitted until fifteen (15) days has elapsed from the date you posted your post, envelope or package to us in order to ensure that your package has had sufficient time to arrive to our offices. Failure to properly complete, sign and/or post the Claim Form together with PROOF OF POSTAGE will result in the denial of the Claim by Glasson Recycling.
Limitation of Liability:
Subject to the terms and conditions set forth herein, Glasson Recycling will be liable only for the maximum sum of Two Hundred Euro (€200). Consequently, the Donor understands and agrees that Glasson Recycling liability is limited to this sum. The Donor agrees to hold Glasson Recycling harmless and to indemnify Glasson Recycling regarding any other losses or damages, including any incidental, indirect, special, consequential, punitive damages, or loss of profit or opportunity; claims, demands, or actions for any subrogation claim brought by the Donor’s insurance company, and, by submitting gold jewellery to Glasson Recycling the Donor expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance company. By submitting the gold jewellery, the Donor explicitly and expressly accepts this limitation of liability. The Donor is free to insure the gold jewellery sent to Glasson Recycling for any amount that the Donor wishes.
Jurisdiction:
The forgottengoldappeal.com website is operated and controlled by Glasson Recycling from Ireland. If you access the forgottengoldappeal.com website you do so at your own initiative and at your own risk and you are responsible for compliance with the applicable laws and regulations of the location in which you access the forgottengoldappeal.com website. The Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and the Irish courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in connection with the forgottengoldappeal.com website or the materials. If any provision of the Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
Changes:
Any changes to the Terms and Conditions will be posted on the forgottengoldappeal.com website. Any such changes shall become immediately effective when posted. By using the forgottengoldappeal.com website you agree to be bound by any such changes and, therefore, you should from time to time visit the forgottengoldappeal.com website to determine the Terms and Conditions by which you are bound. Glasson Recycling, may at any time, without liability modify, suspend or discontinue the forgottengoldappeal.com website, the goods or services advertised on the forgottengoldappeal.com website, or any part thereof, with or without notice for any reason whatsoever.
